Expert opinion or the Ministry of Economy website: Automobile commissions will be able to choose the type of vehicle assessment
After the draft law No. 12266, adopted by the Parliament as a whole, as reported by Peopleʼs Deputy Yaroslav Zheleznyak on December 17, is published in the official publication, car commissions (i.e. entities that conduct business activities in the supply of used goods (commission trade), accepted under a commission agreement) will receive a new opportunity to conduct an assessment of vehicles that they have taken on commission.
What it is about: the commission agreement should indicate the value of the car. According to the Tax Code, it was previously defined as “not lower than the average market price” for car commission agents. This was a kind of “safety net” so that those who have to pay tax on the sale of a car would not underestimate its price to a few hryvnias, thereby effectively avoiding taxation. However, not all cars have an average market value — the actual price depends not only on the mileage and condition, but also on the completeness, damage, etc. At the same time, according to the principle currently enshrined in Article 189.3 of the Tax Code, only an expert who has the official right to conduct such activities could provide an assessment.
According to the new rules approved today, the ability to indicate the price is added both from a certificate from an expert and from the Ministry of Economy website, which has a special section "Vehicles — cost calculation." It is clear that the second option is free, unlike the first.
So, in practice, if all parties to the purchase and sale agreement agree with the assessment of the Ministry of Economyʼs "calculator", the issue of assessment can be closed there. If the car is damaged, requires expensive repairs, or is incomplete, then it is worth contacting an expert who will provide an accurate assessment of the vehicle, taking into account all the features of its condition.
However, the selection of models in the "evaluation calculator" is currently so limited that it can hardly be called completely universal. That is, there is a high probability that there will be no truly popular models there. However, this is the case today — perhaps the model database will be expanded soon.
