In mid-December, new rules for buying and selling cars will come into effect in Ukraine: it will be possible to re-register a car on a smartphone, using the Diya mobile application. Experts of the Institute of Car Market Research studied the updated legal framework in detail and explained how the sale of a car online will take place in practice. It turned out that there are nuances.
The possibility of re-registering a car without visiting the Service Centers of the Ministry of Internal Affairs became possible as a result of the adoption of Cabinet Resolution No. 1019 of September 10, 2022. This document changed the procedure for registering and re-registering vehicles, giving Ukrainians the right to choose: contact the Service Center or go through the procedure online, in a personal in the driverʼs office or in the "Diya" mobile application. The mechanism will begin to operate in the near future: three months from the time of publication provided for by the resolution will pass in mid-December.
Who can re-register a car online?
Such an opportunity will be available only for individuals. That is, if the buyer or seller is a legal entity (company), it will be possible to sell the car only in the classic way.
It will not be possible to re-register a car for the sale of which tax must be paid. This is, according to Ukrainian legislation, all vehicles, except cars, motorcycles and mopeds, if this is the first sale during the reporting tax year. The fee must be paid for the second and all subsequent cars sold during the year.
That is, only these three categories of vehicles will be able to be re-registered online in Diya:
- passenger cars;
- motorcycles;
- mopeds
The service will also be refused if:
- the results of checking against registers and databases will establish the fact that the vehicle or natural person is wanted, the presence of relevant restrictions or encumbrances;
- there is no information on the registered place of residence in the Unified State Demographic Register;
- during the verification of the relevant information entered in the electronic form, inaccurate information or discrepancies were found. In this case, the funds paid for the provision of the service are not returned.
First — an expert study
At the time of re-registration of the car online, the electronic conclusion of the expert study must be uploaded to the Unified State Register of Vehicles. It can be obtained by providing the car for a physical examination by employees of the Expert Service of the Ministry of Internal Affairs or other state specialized institutions.
From now on, such a study is mandatory, and it is carried out with the aim of determining the authenticity of vehicle identification numbers and registration documents (detecting the facts of destruction, forgery or changing the numbers of units and aggregates of vehicles, forgery of registration documents), and includes an inspection of the vehicle and a comparison of information, included in its registration documents. Instead, the car will not be inspected additionally at the Service Center.
The inspection report is valid for only 10 days, so during this period you need to re-register the car. Otherwise, the study will have to be repeated.
What will the procedure of car re-registration online look like in practice?
- You need to log in to the driverʼs electronic account or the Action Portal.
- The owner (seller) must submit an application in electronic form. Its fields will be filled in automatically, the system will upload the necessary data from the relevant databases.
- The seller and the buyer must put electronic signatures on the documents. The sales contract will be considered concluded online.
- Employees of the service center of the Ministry of Internal Affairs will check information about the owner and the vehicle against the relevant registers and databases.
- After that, the electronic version of the registration certificate will appear in the Diya mobile application.
- The new owner must physically arrive at the Service Center of the Ministry of Internal Affairs, where they will hand in the old license plates and registration certificate, and receive new documents in return. It will be possible to do this outside the queue, without waiting in the general queue and without receiving a "coupon".
Despite the fact that the electronic office and "Diya" work 24/365, the documents must pass a physical check, which is performed by a person, an employee of the Ministry of Internal Affairs, so it will not be possible to re-register the car at any time. If these inspections will be carried out only during the working hours of the SC, then, accordingly, you will have to wait until a free employee appears who will undertake to process the application. If the work of on-duty workers is improved, then the availability of the service will expand over time, and the efficiency of its implementation will increase.
However, it sometimes happens that in practice some quite good ideas may not be implemented exactly as the initiators imagined them. So how it all works will become clear in just a few weeks.
Whatʼs next?
The possibility of re-registration of vehicles in "Diya" is an important element in the formation of a civilized car market. It is the digitization of this sphere that will increase transparency, reduce corruption and eradicate fraud, experts of the Institute of Car Market Research emphasize.
Most of all, the new service will affect the reduction of queues at Service Centers and manipulations around it. Even if the car is bought in another region, it is enough to pass an expert study, process the purchase on the spot with the help of "Diya", and receive physical documents in a few days in the region of residence.
Among the shortcomings, experts single out the limited scope of application of the new rules. Businesses (legal entities) will not be able to use the new system, as well as during the sale of other types of vehicles, the sale of which requires payment of taxes. Also, registration in "Diya" involves only re-registration, i.e. changing the owner of a car already registered in Ukraine. The first registration of a "freshly driven" car will continue to take place with a visit to Service Centers. However, these are plans for the future, which, with a high probability, will also be implemented over time.
